{"id":5810,"date":"2023-10-27T13:44:20","date_gmt":"2023-10-27T13:44:20","guid":{"rendered":"https:\/\/diskdrive33.com\/mks\/?p=5810"},"modified":"2024-02-14T12:01:09","modified_gmt":"2024-02-14T12:01:09","slug":"comment-new-economic-crime-act-in-uk","status":"publish","type":"post","link":"https:\/\/diskdrive33.com\/mks\/2023\/10\/27\/comment-new-economic-crime-act-in-uk\/","title":{"rendered":"COMMENT | New Economic Crime Act in UK"},"content":{"rendered":"<ul>\n<li><strong>UK&#8217;s Economic Crime and Corporate Transparency Bill passes into law<\/strong><\/li>\n<li><strong>Heralded as a major shakeup of UK approach to economic crime<\/strong><\/li>\n<li><strong>Some have criticised the measures as not going far enough<\/strong><\/li>\n<\/ul>\n<hr \/>\n<p>Major reforms to how the UK polices and prevents fraud and corruption became law on Thursday, under sweeping new measures designed to tackle economic crime.<\/p>\n<p>The Economic Crime and Corporate Transparency Bill <a href=\"https:\/\/www.lawgazette.co.uk\/law\/economic-crime-act-divides-expert-commentators\/5117688.article\">received Royal Assent<\/a> after a long debate in the House of Lords and the House of Commons, and following a battle over amendments added by the Lords (which were eventually dropped).<\/p>\n<p>The UK government, and Home Secretary Suella Braverman, claim that the new law will strengthen the hands of prosecutors and help them tackle the flow of dirty money.<\/p>\n<p>Others have said the measures <a href=\"https:\/\/www.cityam.com\/will-the-economic-crime-act-tackle-the-uks-350bn-fraud-issue\/\">fall short of what&#8217;s needed<\/a> to tackle the UK&#8217;s burgeoning financial crime problem and that the measures lack enough new resources to make them stick.<\/p>\n<p>Our Head of Advocacy, Charles Bott KC, had <a href=\"https:\/\/diskdrive33.com\/mks\/2023\/09\/22\/mks-calls-out-uk-governments-approach-to-economic-crime-legislation\/\">previously welcomed<\/a> House of Lords amendments added to the Economic Crime and Corporate Transparency Bill.<\/p>\n<p>He called them &#8220;useful and sensible amendments which strengthen the bill&#8221; \u2013 notably measures to ensure small and medium-sized business would also be covered under the new failure to prevent fraud measure (now dropped).<\/p>\n<h3><span style=\"color: #003366;\">Some key provisions of the new Act include:<\/span><\/h3>\n<p>\u25fe a new criminal offence of &#8220;Failure to Prevent Fraud&#8221;<br \/>\n\u25fe long-promised Companies House reform<br \/>\n\u25fe reforms to prevent the abuse of limited partnerships<br \/>\n\u25fe changes to the identification doctrine<br \/>\n\u25fe powers to seize and recover suspected cryptoassets<br \/>\n\u25fe reforms to improve information sharing<br \/>\n\u25fe new intelligence gathering powers for law enforcement<\/p>\n<h3><span style=\"color: #003366;\">Responding to the new Act, MKS Head of Investigations, Tony McClements, said:<\/span><\/h3>\n<blockquote><p>&#8220;Like most professionals in the counter-fraud and anti-corruption field, I welcome the new Economic Crime and Corporate Transparency Act.<\/p>\n<p>&#8220;However, at the risk of sounding underwhelmed, as a former fraud squad detective I am eager to see how the legislation will be utilised by law enforcement whose focus and priorities appear to lie elsewhere \u2013 hence the UK&#8217;s appalling record in bringing fraudsters to justice.<\/p>\n<p>&#8220;In particular, I welcome the effort to overhaul Companies House.
