Nissan vs Ghosn trial to go ahead in BVI<\/span><\/h3>\n

A high-value and high-profile civil fraud claim against ex-Nissan CEO and Chairman Carlos Ghosn will now proceed to a full trial in the BVI, after Nissan successfully resisted an application by Mr Ghosn to strike out the claims.\u00a0<\/span><\/p>\n

Nissan is represented by Martin Kenney & Co., Solicitors (MKS)<\/a> in this matter.<\/p>\n

In July 2019, MKS\u00a0was instructed by Nissan to move urgently\u00a0to investigate the status of a \u2018super yacht\u2019 \u2013\u00a0\u201cShachou\u201d (meaning \u201cThe Boss\u201d), and now styled\u00a0\u201cThe Twig\u201d \u2013 on the basis of evidence\u00a0indicating\u00a0that former Nissan CEO and Chairman Carlos\u00a0Ghosn had acquired the yacht with money\u00a0wrongly taken from Nissan.<\/p>\n

MKS swiftly moved the BVI Commercial\u00a0Court for a freeze order against the registered\u00a0title to the vessel, which was subsequently frozen. MKS filed a US$32 million claim\u00a0in the BVI for recovery of the yacht for Nissan, as well as for damages.<\/p>\n

MKS instructed George Spalton QC of 4 New Square<\/a>, who led\u00a0Joshua Folkard \u2013 Twenty Essex<\/a> in Nissan’s successful defense of Mr Ghosn’s strike-out application.<\/p>\n
