As an attorney who is also a Canadian national, I ply my trade as an international fraud lawyer and cross-jurisdiction asset recovery specialist. So it pains me when I am forced to consider the regulatory failings of my home nation.<\/strong><\/p>\n

The infamous 2016 Panama Papers leaks revealed that a legion of tax advisers had been using our country to help hide assets. The story became known as the \u201csnow washing\u201d scandal<\/a> after Toronto tax lawyer Jonathan Garbutt described the process of making a company as clean as the \u201cdriven snow in the Great White North,\u201d often by laundering funds through Canadian real estate.<\/p>\n

As we approach the conclusion of the difficult year that is 2020, it appears that Canada continues to lack the rigorous checks and balances required to protect society from the con artists who would exploit its financial systems.<\/p>\n

One commentator, Diane Francis, recently outlined<\/a> why Canada is failing so badly here. Prior to that, she pointed out<\/a> that Transparency International has ranked Canada at the bottom of all the G20 countries, due to its failure to meet G20 anti-money-laundering commitments. Francis placed some of the (political) blame for all this on what she called \u201cself-righteous Liberals.\u201d<\/p>\n

I have no wish to make this post political: what matters is what has gone wrong and how we fix it.<\/p>\n

First, we must acknowledge that we are getting it wrong with regards to our anti-money-laundering protections. Countering any form of financial crime is now a nightmare due to the realities afforded by the internet and the almost risk-free opportunities it affords to crooks.<\/p>\n

If we add to this borderless playground the lying and cheating that takes place when fraudsters complete paperwork (and the use of \u201cmen of straw\u201d to act as fake ultimate beneficial owners on registration documents), those in the regulated sectors have a major job on their hands simply to undertake meaningful due diligence.<\/p>\n

From the outset, we must recognize that Canada is not on its own here. Other global heavyweights such as the U.S., U.K. and those who make up the EU are also combating the same problems. Nobody is winning this uphill battle.<\/p>\n

All we can collectively do is to try and frustrate the crooks as best we can. It is here where Canada needs to up its game \u2014 we don\u2019t want our great country to become a bolthole for the illicit funds of thieves and vagabonds.<\/p>\n

Indeed, due to its positive international image, Canada is seen by some of the more discerning crooks as their money-laundering venue of choice. This says much about how Canada\u2019s reputation among the international community could be damaged if the \u201csnow washing\u201d problem continues unabated.<\/p>\n

In fairness, Canada is trying to identify and address its regulatory weaknesses. For example, B.C. Premier John Horgan launched a commission<\/a> in May 2019 looking into money laundering in the province.<\/p>\n

Led by Austin Cullin, the commission\u2019s mandate includes looking at \u201cthe extent, growth, evolution and methods of money laundering\u201d in B.C., and \u201cthe acts or omissions of responsible regulatory agencies and individuals, and whether those have contributed to money laundering in the province or amount to corruption.\u201d<\/p>\n

It will also examine the scope and effectiveness of anti-money-laundering powers and the barriers to effective law enforcement in relation to money laundering.<\/p>\n

The issues facing Canadian regulators are too innumerable to mention in a short piece. What we can say is that those of us plying our trade in this field know and understand what caused the past failures.<\/p>\n

As to how we rectify the situation, the establishment of the ongoing Cullen commission, whatever its outcome, is a sizable step forward for Canada as a whole in terms of addressing the money-laundering issues that continue to blight our nation.<\/p>\n
